Terms and Conditions

1. These general terms and conditions apply to personal training at Raphaela Hefti. As a rule, ECLIPSE LIFESTYLE GmbH (training provider) concludes a contract with the customer or provide the customer with a written customer dossier including a training agreement. The following provisions apply to all Raphaela Hefti customers. Customer-related personal training. Individually different agreements take precedence provided that they are agreed in writing in the customer dossier.

2. The training agreement is concluded between the customer and the training provider. Minor customers must have the training agreement signed by their legal representative.

3. The training is generally carried out by the trainer specified in the customer dossier or agreed between the parties. The training provider can appoint another person as a trainer in consultation with the customer.

 

4. The price for the training is listed under the “Prices” chapter in the customer dossier. on the website at www.raphaelahefti.com/XXXXX.

 

5. ​The term of the training agreement ends with the last paid training session. If the paid training units are not redeemed, the entitlement to training units expires two years after the training agreement has been concluded. two years after the last booked training session, unless the customer submits a credibly justified and written request for an extension of the term of the training agreement. The invoice amount will not be refunded.

 

​6. The respective invoice amount is due immediately after the invoice has been issued. The price includes training and coaching with the trainer. Any expenses and additional costs must be paid by the customer.

 

7. The training provider reserves the right to postpone training dates with sufficient advance notice. The customer or The customer can cancel already agreed training appointments free of charge up to 48 hours before the start of the training. Appointments canceled later will be charged in full. are considered purchased. In the case of group training, postponements apply to all training participants, unless otherwise agreed.

 

8th. In the event of illness, accident or force majeure, an appointment can be postponed at short notice (i.e. with less than 48 hours' notice) without incurring any costs. The customer or The customer must be able to credibly prove the reason for the short-term postponement.

 

9. Insurance is the responsibility of the customer. The customer or The customer confirms that she is adequately insured against the consequences of accidents and illness. Any liability for any damage that occurs or any consequential damage that the customer or the customer gets injured due to accident or illness during training is expressly excluded. The customer or the customer confirms that he/she is healthy enough to be able to do sports.

 

10. The training provider assumes no liability for items stolen or lost before, during or after the training sessions. The respective house or field rules apply at the training locations.

 

11. The training provider expressly reserves the right to make any price adjustments and contract changes. Corresponding changes will be communicated to the customer or communicated to the customer in writing in a timely manner.

 

12. The information in the customer dossier applies. the provisions regarding confidentiality and data protection listed on the website at www.raphaelahefti.com/datenschutz/XXXXX.

 

13. Changes of address must be communicated to the training provider.

 

14. Swiss law applies. The exclusive place of jurisdiction for all disputes is the competent courts at the registered office. Residence of the training provider.
